Rationale of fair use for Everything That Happens Will Happen Today and Strange Overtones

This is a sound sample from a commercial recording of the album and a free download of the single. Its inclusion here is claimed as fair use because:

  • It illustrates an educational article specifically about the song from which this sample was taken. The section of music used is discussed in the article in relation to the song's lyrics, musical and vocal style, and also contains part of the song's chorus. The lyrics help to explain the genre of music and themes of the album.
  • It is a sample of no more than 10% of the length of the original recording, and could not be used as a substitute for the original commercial recording or to recreate the original recording.
  • It is of a lower quality than the original recording.
  • It is not replaceable with an uncopyrighted or freely copyrighted sample of comparable educational value.
  • It is believed that this sample will not affect the value of the original work or limit the copyright holder's rights or ability to distribute the original recording.

I believe that this use of the excerpt is in good faith, and that its inclusion enhances the quality of the articles in question, without reducing the commercial value of the recording from which it was drawn. (At the time of this writing, Strange Overtones is a redirect, but if the article is created, it would be appropriate to have an audio sample.) —Justin (koavf)T☮C☺M☯ 00:16, 8 August 2008 (UTC)

Creation

The file was created by playing the free MP3 download (MPEG-1 layer 3, 320 kbit, 44100Hz Joint Stereo) and recording the song through my computer's soundcard using Mp3 My Mp3 as a WAV. This WAV was exported to Audacity and converted to Ogg Vorbis using the criterion suggested at Wikipedia:Music samples.
